5. Payment

Standard Products: 30-day return window for defects or errors on our part
Custom Products: Non-returnable except for manufacturing defects

8. Intellectual Property

All content on the Platform (text, graphics, logos, software, designs) is owned by TshirtLoop or our licensors and protected by copyright, trademark, and other intellectual property laws.

8.2 Your Content

By uploading designs, images, or text ("Your Content"), you:

Grant us a license to use, reproduce, and display Your Content for order fulfillment and marketing (with your consent)
Represent that you own or have rights to Your Content
Warrant Your Content does not infringe third-party rights
Agree we may use Your Content in portfolio/testimonials (with your consent)

8.3 Prohibited Content

You may not upload content that:

Infringes intellectual property rights (copyrights, trademarks, patents)
Contains hate speech, threats, or harassment
Depicts illegal activities or violence
Contains explicit sexual content
Violates privacy or publicity rights
Uses trademarked brands without permission (Nike, Disney, etc.)

8.4 Takedown Policy

9. AI-Generated Designs

9.1 AI Service

AI design generation is powered by third-party services (OpenAI, Replicate)
AI-generated designs are provided "as-is" without guarantees
We are not responsible for AI output quality or accuracy

9.2 Ownership

You retain ownership of AI-generated designs created through your account
AI providers may retain rights per their terms of service
You are responsible for ensuring AI designs don't infringe third-party rights

10. Prohibited Activities

You may not:

Use the Service for illegal purposes
Impersonate others or provide false information
Interfere with or disrupt the Service (hacking, DDoS, malware)
Scrape, crawl, or data mine the Platform
Reverse engineer or decompile our software
Resell products without written permission
Create multiple accounts to abuse promotions
Upload viruses, malware, or harmful code

11. Disclaimers

11.1 "AS-IS" Service

The Service is provided "AS-IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including:

Merchantability, fitness for a particular purpose, non-infringement
Uninterrupted, error-free, or secure operation
Accuracy, reliability, or timeliness of content

11.2 Third-Party Services

We use third-party services (payment, shipping, AI). We are not responsible for their failures, errors, or service interruptions.

12. Limitation of Liability

To the maximum extent permitted by law:

We are not liable for indirect, incidental, consequential, or punitive damages
Our total liability shall not exceed the amount you paid for the order in question
This includes damages from errors, delays, data loss, service interruptions, or unauthorized access

13. Indemnification

You agree to indemnify and hold TshirtLoop harmless from claims, damages, losses, and expenses (including legal fees) arising from:

Your violation of these Terms
Your Content infringing third-party rights
Your use of the Service
Your violation of applicable laws

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles.

14.2 Arbitration

Any disputes shall be resolved through binding arbitration under the American Arbitration Association (AAA) rules, except:

Small claims court actions (disputes under $10,000)
Intellectual property disputes

14.3 Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class actions or class arbitrations.

Savings Clause: If any portion of this arbitration agreement, including the class action waiver, is found unenforceable, only that portion shall be severed. The remainder of the arbitration agreement remains in full force and effect.

15. Modifications

15.1 Changes to Terms

We may modify these Terms at any time. Changes are effective upon posting. Your continued use constitutes acceptance.

15.2 Service Changes

We may modify, suspend, or discontinue the Service (or any part) at any time without notice or liability.

16. General Provisions

16.1 Entire Agreement

These Terms, along with our Privacy Policy and Refund Policy, constitute the entire agreement between you and TshirtLoop.

16.2 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

16.3 Waiver

Our failure to enforce a right does not waive that right.

16.4 Assignment

You may not assign these Terms without our consent. We may assign these Terms without restriction.

Force Majeure

TshirtLoop shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemics, acts of war or terrorism, government actions, supply chain disruptions, labor disputes, power outages, or internet service disruptions. In such events, delivery times and order fulfillment may be extended without liability.

Color Accuracy & Print Disclaimer

Color Variation: Colors on your screen may differ from the final print due to monitor settings and display technology
Material Variation: Results may vary by garment color, fabric type, and composition
Not a Defect: Minor color variations between screen and print are inherent to the process and do not constitute a defect or grounds for refund
Pantone Matching: We do not guarantee exact color reproduction. Contact support before ordering if precise matching is critical

Fraud Prevention & Order Verification

TshirtLoop reserves the right to verify identity and payment before processing orders, refuse or cancel suspected fraudulent orders, limit order quantities, suspend accounts associated with fraud, and report suspected fraud to law enforcement and payment processors.

Electronic Communications Consent

By using TshirtLoop, you consent to receive electronic communications per the E-SIGN Act (15 U.S.C. 7001). Electronic communications satisfy any legal writing requirement. You may withdraw consent by contacting support, though this may limit functionality. Paper copies available upon request.

AI-Generated Content

Ownership

License: You receive a non-exclusive, worldwide, royalty-free license to use AI-generated designs for personal and commercial use on products ordered through TshirtLoop
No Copyright Guarantee: Under current U.S. law, purely AI-generated works may not qualify for copyright protection. We make no representations regarding copyrightability
No Exclusivity: AI tools may generate similar designs for different users. We do not guarantee exclusivity
Your Inputs: Original text, images, or creative direction you provide remains your intellectual property

AI Data Processing

Design prompts are sent to third-party AI providers (e.g., OpenAI) for processing
We do not use your uploaded designs or personal data to train AI models
AI providers process data per their privacy policies and our data processing agreements

AI Content Liability

You are solely responsible for reviewing AI-generated designs before ordering. TshirtLoop is not liable if AI output inadvertently resembles existing copyrights, trademarks, or IP. You agree to indemnify TshirtLoop against claims arising from your use of AI-generated designs.

Acceptable Use Policy — Design Studio

You agree NOT to submit content that:

Infringes IP: Copyrighted images, logos, or designs you do not own (sports team logos, brand logos, celebrity likenesses, cartoon characters, movie/TV imagery)
Contains Hate Speech: Content promoting violence or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin
Is Obscene or Illegal: Pornographic content, content promoting illegal activities, or content violating federal, state, or local laws
Constitutes Counterfeiting: Designs replicating branded merchandise, currency, or government documents
Violates Privacy: Content containing personal information or likenesses of individuals without consent

Enforcement

TshirtLoop may refuse orders, remove content, suspend accounts, or report illegal content to law enforcement. No refunds for AUP violations.

DMCA Copyright Policy

TshirtLoop respects intellectual property rights. In accordance with the DMCA (17 U.S.C. § 512), we respond promptly to copyright infringement claims.

Filing a Takedown Notice

Send written notice to our DMCA agent containing: (1) your signature; (2) identification of the copyrighted work; (3) identification of the infringing material with enough detail to locate it; (4) your contact information; (5) a good faith belief statement; (6) a statement under penalty of perjury that the notice is accurate.

Counter-Notification

If your content was wrongfully removed, submit a counter-notification with: your signature, identification of removed material, a statement under penalty of perjury that removal was a mistake, and consent to federal court jurisdiction in Harris County, Texas.

Repeat Infringer Policy

Accounts receiving three or more valid DMCA notices will be permanently terminated without refund.
